Friday March 17, 2023 – An Eldoret Court has nullified the nomination of 11 Members of the County Assembly (MCA) who were all members of the United Democratic Alliance (UDA) party, Uasin Gishu Branch
While issuing the ruling, Chief Magistrate Dennis Mikoyan stated that the Independent Electoral and Boundaries Commission (IEBC) had illegally gazetted the nominations yet the list had been disowned by the Political Parties Tribunal.
Magistrate Mikoyan further stated that the MCAs were not in the original list of nominations which was filed by UDA.
According to the court, the legitimate list of the nominated MCAs was the one dated July 27, 2022, and not the one filed by the party on August 24th, 2022.
The court, therefore, directed that the initial list dated July 27, 2022, be applied.
The ruling followed a petition filed by two residents of Uasin Gishu, Celestine Mutai and Robert Kiptanui.
Earlier in September 2022, IEBC gazetted a list of 14 nominated MCAs in Uasin Gishu.
Out of the 14, 13 MCAs were members of UDA and one was a member of the Jubilee Party.
The MCAs were nominated in the marginalised category and the gender top-up category.
Gazetted nominated MCAs in Uasin Gishu included Mercy Jepkurui of Jubilee, Cherono Caroline, Chelimo Juliet, Kebenei Magrinah Chebet, Aidid Sahra Abdi, Hassan Saida Chepkoech, Kiboi Chemtai Nancy and Rebecca Jerop from UDA.
Others included Kemboi Roda Jelagat, Serem Naomi Chepkemboi, Tirop Evarlyne Chepkoech, Waiganjo David Waweru, Tirop Belinda Chebichii and Wachira James Maina from UDA.
Weeks after the nominations, residents of Uasin Gishu protested the list, stating that they had not been distributed across the political parties including limited representation of persons with disabilities.
