Friday, June 19, 2020 – A police officer who is accused of killing a 13-year old in Kiamaiko, Nairobi, failed to appear in court with his lawyers claiming that he had developed symptoms consistent with Covid-19 and had gone for a test at Mbagathi Hospital.
The cop identified as Dancun Ndiema was to be charged with killing Yasin Moyo on March 30.
The plea taking was pushed to Tuesday depending on the outcome of the test.
His lead lawyer, Danstan Omari, told Justice Daniel Ogembo that he will present the officer before court either physically or virtually to answer the charges once he gets a clean bill of health from doctors.
“The suspect is at Mbagathi Hospital and this being a sensitive disease, I propose we take a new mention date,” Omari said.
However, State Counsel Wangui Gichuhi, sought a warrant of arrest or summons for Ndiema adding that if he has Covid 19, the state can facilitate his stay.
Justice Ogembo directed investigations into Ndiema’s status be conducted by the Independent Policing Oversight Authority.
The defence was also directed to table all the test records of the accused before the court.
Moyo was on the balcony watching police patrol the streets while enforcing the coronavirus-related curfew when a stray bullet struck him in the stomach.
