Thursday June 18, 2020 – Nairobi Governor, Mike Sonko, is smiling all the way to the bank after a Nairobi Court declared the Deed of Transfer of Functions he signed with the Executive as ‘vague and unconstitutional’.
Making the ruling on Thursday, Judge Hellen Wasilwa of the Employment and Labor Relations Court also stated that the transfer of 6,000 County Government employees to the newly established Nairobi Metropolitan Services (NMS) was illegal.
The Judge said the deed was illegal because it was not approved by the County Assembly.
She gave the national Government, under the leadership of President Uhuru Kenyatta, 90 days to isolate various illegalities identified in the ruling.
The ruling is expected to complicate matters for the NMS led by Major General Mohammed Badi, which has already seen various functions transferred to it including construction of roads.
Mike Sonko signed the deed in State House, Nairobi, on February 25th in the presence of President Uhuru Kenyatta and Devolution Cabinet Secretary Eugene Wamalwa, but later claimed that he did not have an opportunity to read it.
